What is the Grants of Probate fees Consultation?

In February 2016 the Ministry of Justice proposed to discard the flat fee payable for an application for a grant of probate. Currently, this is set at £155 if made by a solicitor and £215 if made by an individual. The consultation proposes a progressive regime of fees based on estate value, and to raise the fee exemption from estates valued up to £5,000 to estates valued up to £50,000.
The IFB responded to the consultation raising its concern about the potentially damaging impact the proposed changes would have on family businesses with estates valued over £50,000, and that the proposed rates do not reflect the cost of processing an application.
